Rifft Safety E-commerce Site Terms and Conditions of Service

Rifft Safety (hereinafter referred to as “we”, “us”, “our”, or “Rifft Safety”) provides an e‑commerce service (the “Service”) via our website (the “Site”). By using the Site, you agree to be bound by these Terms and Conditions (“Terms”). These Terms apply to all users of the Site, including without limitation browsers, vendors, customers, merchants and contributors of content.
Please read these Terms carefully before accessing or using our Site. By accessing or using any part of the Site, you agree to be bound by these Terms. If you do not agree to all the Terms, you must not access the Site or use the Service.
1. Compliance with New Zealand Laws
Our Service operates within the legal jurisdiction of New Zealand. It is your responsibility to ensure compliance with all laws, rules and regulations in your own jurisdiction, as well as those in New Zealand. By accessing our Site and using our Service, you agree to comply with (without limitation) the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Privacy Act 2020 and the Electronic Transactions Act 2002.

3. Terms of Sale
By placing an order for any product on our Site you are offering to purchase the product on, and subject to, these Terms. All orders are subject to availability and confirmation of the order price. To contract with Rifft Safety you must be at least 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us.
4. Intellectual Property Rights
All intellectual property rights in software and content made available to you on, or through, the Site remain the property of Rifft Safety or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by Rifft Safety and its licensors.
5. Content Accuracy
We strive to be as accurate as possible, however we do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current or error‑free.
6. Limitation of Liability
To the maximum extent permitted by law, Rifft Safety will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues (whether incurred directly or indirectly), or any loss of data, use, goodwill or other intangible losses arising from: (a) your access to, use of, inability to access, or inability to use, the Site; (b) any third‑party conduct or content on the Site, including any defamatory, offensive or illegal conduct of third parties; or (c) any unauthorised access, use or alteration of your content.
7. Communications and Marketing Consent
By purchasing a product or engaging Rifft Safety to provide any Service you consent to receiving communications from us, including but not limited to order confirmations, shipping and delivery updates, service notifications, newsletters, promotional offers and other marketing material. You may opt out of marketing communications at any time by following the unsubscribe instructions provided in the communication or by contacting us at hello@rifft.co.nz. Opting out of marketing communications will not prevent us from sending you transactional or service‑related messages that are necessary to fulfil your order or the Service we provide.
8. Indemnity
You agree to indemnify, defend and hold harmless Rifft Safety, its directors, officers, employees, consultants, agents and affiliates, from any and all third‑party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of the Site or your breach of these Terms.
9. Changes to Terms and Conditions
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to the Site. It is your responsibility to check the Site periodically for changes. Your continued use of, or access to, the Site following the posting of any changes constitutes acceptance of those changes.
These Terms, together with any document expressly referred to in them, constitute the entire agreement between you and Rifft Safety and supersede any prior agreement, understanding or arrangement between you and us, whether oral or in writing.
These Terms are governed by and construed in accordance with New Zealand law, and you agree to submit to the exclusive jurisdiction of the New Zealand courts.
